About our Photo + Video Licensing:

 

Please Read Carefully ! We are relatively easy with our Licensing :-) . . .

There are some things you should know, however, when it comes to WHO OWNS THE PHOTOS AFTER YOU HIRE US FOR A PHOTO SHOOT.

Under current copyright laws, the copyright of photographs remains with the photographer, unless otherwise specifically agreed upon. ALL IMAGERY produced by Kohalafoto Films are under copyright, any transfer or alterations of our Imagery is strictly not permitted without our consent.

 

RESIDENTIAL / MLS
Client is granted a limited, short term (until property is sold not to exceed 1 year) and non-transferable license, to use the photographs in digital or print, or video form for any advertising or promotional purposes associated with Client’s efforts to sell/lease or offer to sell/lease the property depicted in the photographs/images, such as use in a real estate listing, realtor advertisement of listings, a web-based virtual tour of the subject property, and the like. Once Client’s involvement in the sale/lease or offer for sale/lease of the subject property terminates, then this license terminates with it, and Client has no further license to use the photographs/video, except for the very limited purpose of advertising or referencing that the property depicted in the photographs/video was a property previously listed, sold, or leased by the Client. Client does not have any right to transfer, sell or otherwise provide the photographs/video, or the limited license granted to Client, to any third party. If a third party desires to use the photographs/video, then the third party must first contact Kohalafoto Films to inquire about purchasing an extended license.

COMMERCIAL:

Kohalafoto Films exclusively owns and retains all worldwide rights, including copyright, in and to all photographs and images, in any form, including digital and print media it provides to Client. Client is granted an unlimited use license of photographs/images in digital or print form for any advertising or promotional purposes for a timeframe specified (1 year, 5 year or otherwise as written in a contract). Client is purchasing this license for an unlimited amount of time. Client does not have any right to share photographs/images in digital or print form. Client does not have any right to transfer, sell or otherwise provide the photographs/images, or the license granted to Client, to any third party. If a third party desires to use the photographs/images, then the third party must first contact Kohalafoto Films to inquire about purchasing a license.
